These Terms of Service ("Terms") govern your use of the Forgetmenaut software and services (collectively, the "Service") provided by Forgetmenaut, Inc. ("Forgetmenaut", "we", "us", or "our").
By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these terms, please do not use the Service.
1. Definitions
- "Service" refers to the Forgetmenaut software, website, and any related services provided by Forgetmenaut, Inc.
- "User," "You," "Your" refers to the individual or entity that has registered for an account to use the Service.
- "Customer Data" refers to any data, information, or material provided or submitted by you to the Service in the course of using the Service.
- "Intellectual Property Rights" refers to all patents, copyrights, trademarks, trade secrets, and other intellectual property rights.
2. User Accounts & Conduct
To use the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
3. Acceptable Use Policy
You agree not to use the Service for any unlawful purpose or in any way that could harm Forgetmenaut, Inc., its service providers, or any other person. You agree not to:
- Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Service.
- Use the Service to transmit any material that is harassing, defamatory, obscene, or illegal.
- Use the Service to violate any applicable laws or regulations, including any data privacy laws.
- Resell or sublicense the Service to any third party without our express written permission.
4. Fees, Payment, and Subscription Terms
The Service is offered on a subscription basis. You agree to pay all applicable fees as described on our pricing page. Fees are billed in advance on a monthly or annual basis and are non-refundable except as described in our Refund Policy. We reserve the right to change our fees with 30 days' notice to you. All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties.
5. Intellectual Property Rights
Forgetmenaut, Inc. owns all right, title, and interest, including all related Intellectual Property Rights, in and to the Service. This Agreement is not a sale and does not convey to you any rights of ownership in or related to the Service. The Forgetmenaut name, logo, and the product names associated with the Service are trademarks of Forgetmenaut, Inc., and no right or license is granted to use them.
6. Confidentiality
Each party (the "Receiving Party") understands that the other party (the "Disclosing Party") has disclosed or may disclose business, technical, or financial information relating to the Disclosing Party's business (hereinafter referred to as "Confidential Information"). Confidential Information of Forgetmenaut, Inc. includes non-public information regarding features, functionality, and performance of the Service. Your Confidential Information includes your Customer Data. The Receiving Party agrees: (i) to take reasonable precautions to protect such Confidential Information, and (ii) not to use or divulge to any third person any such Confidential Information except as is necessary to perform its obligations under this Agreement.
7. Termination of Service
You may terminate your account at any time. We may suspend or terminate your account and your access to the Service if you breach these Terms. Upon termination, your right to use the Service will immediately cease. We will make any Customer Data available for you to export for 30 days following termination, after which we may delete it.
8. Indemnification
You agree to indemnify and hold Forgetmenaut, Inc., its officers, directors, employees, and agents harmless from any and all claims, demands, losses, liabilities, and expenses (including attorneys' fees) arising out of or in connection with your use of the Service or your breach of these Terms.
9. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the State of Delaware without regard to its conflict of law provisions. Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in Atlanta, Georgia, rather than in court.
10. Description of Service
Forgetmenaut is a Software-as-a-Service (SaaS) platform that provides tools for businesses to help achieve compliance with the California Consumer Privacy Act (CCPA), the California Privacy Rights Act (CPRA), and various other state privacy laws. The Service is designed to manage and document privacy-related requests from consumers.
11. User Responsibility for Compliance
You are responsible for using the Service in a manner that complies with all applicable laws and regulations, including but not limited to CCPA, CPRA, and other privacy laws. It is your responsibility to interpret and apply these laws to your business. Forgetmenaut, Inc. provides the tools to facilitate compliance, but we cannot be held responsible for any infractions or penalties resulting from the misuse of our software or failure to comply with your legal obligations.
12. Cookies
We employ the use of cookies. By accessing Forgetmenaut, you agreed to use cookies in agreement with the Forgetmenaut's Privacy Policy.
13. License
Unless otherwise stated, Forgetmenaut and/or its licensors own the intellectual property rights for all material on Forgetmenaut. All intellectual property rights are reserved. You may access this from Forgetmenaut for your own personal use subjected to restrictions set in these terms and conditions.
You must not:
- Republish material from Forgetmenaut
- Sell, rent or sub-license material from Forgetmenaut
- Reproduce, duplicate or copy material from Forgetmenaut
- Redistribute content from Forgetmenaut
This Agreement shall begin on the date hereof.
14. Cancellation and Refund Policy
You can cancel your subscription at any time. If you choose to cancel your service, Forgetmenaut, Inc. will offer a prorated refund for the remainder of the current billing month.
15. Data Handling and Security
Forgetmenaut, Inc. is committed to protecting your data. Our Service does not save or retain your company's proprietary customer data. We do, however, maintain extensive records and audit logs of the privacy requests processed through our platform for your compliance records. The Service allows you to export these historical privacy requests at any time.
16. Geolocation Services
Our service uses MaxMind's GeoLite2 database for fraud detection and spam prevention. This product includes GeoLite2 Data created by MaxMind, available from https://www.maxmind.com/.
Please note that:
- The geolocation data is not guaranteed to be accurate
- The data cannot be used to identify specific households, individuals, or street addresses
- We use this data solely for fraud detection and spam prevention
- The data is provided by MaxMind and is subject to their terms of service
17. Disclaimer
To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our website and the use of this website. Nothing in this disclaimer will:
- limit or exclude our or your liability for death or personal injury;
- limit or exclude our or your liability for fraud or fraudulent misrepresentation;
- limit any of our or your liabilities in any way that is not permitted under applicable law; or
- exclude any of our or your liabilities that may not be excluded under applicable law.
The limitations and prohibitions of liability set in this Section and elsewhere in this disclaimer: (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under the disclaimer, including liabilities arising in contract, in tort and for breach of statutory duty.
18. Changes to Terms
We reserve the right to revise these terms and conditions at any time. By using this website you are expected to review these terms on a regular basis.
